Nova Scotia bankruptcy Q&A forum

Question:

If I file for bankruptcy can a bank that I have a credit card with, take funds from my bank account toward the credit card payment during or after bankruptcy proceedings? Thank you for your time. Bob

Hi Bob, thank you for your question. When you file for bankruptcy one of your requirements is to surrender all credit cards to the trustee. If you have funds in a bank account where you also had a credit card, the bank has the right to apply those funds to your credit card debt at time of your filing. To avoid this issue, we recommend prior to filing the bankruptcy you change your banking institution. If youd like to discuss your situation in more detail, we would be happy to review things in a free confidential consultation. Which can be booked through our toll free number 310-6060. Kaitlin
